Welcome to Softnix Gen AI ("System", "Platform" or "Software"). Thank you for choosing our software. The Platform is provided by Softnix ("we", "our" or "Softnix"). This document is the Platform Terms and Conditions of Use (the "Agreement"), which govern all access to and use of our Platform, including the software, APIs, and related content. By accessing or using our Platform, you ("User" or "Customer" or "you") agree to be bound by this Agreement. Please read this Agreement carefully before using the Platform.
1. Acceptance of the Agreement
You must be at least 18 years of age to use the Platform. Your use of this system confirms that you are of legal age and legal capacity to enter into a contract and be bound by this Agreement.
If you are using the Platform on behalf of an organization or legal entity, you confirm that you have full authority to bind the organization under this Agreement.
2. Use of the Platform
Permission: We allow you to access and use the Platform as set forth in this Agreement. You must comply with all applicable laws and our Usage Policies.
2.1 Restrictions on Use
You agree not to:
- 2.1.1 Use the Platform in an unlawful, harmful way or infringe the rights of others.
- 2.1.2 Attempt to reverse engineer, disassemble components, or attempt to access the source code of the Service.
- 2.1.3 Use the platform to develop artificial intelligence products or models that compete with Softnix Gen AI.
- 2.1.4 Transmit harmful information such as viruses, malware, or other malicious code.
- 2.1.5 Avoid or attempt to circumvent the security measures we have in place.
- 2.1.6 Use output information about an individual for purposes that may have a legal or material impact on that person, such as making decisions about credit, employment, or medical treatment.
3. Content and Ownership
Input
You own the data. Any text or content that you enter into the system ("Input") in its entirety. You are responsible for the accuracy and legality of the Input and certify that you have the necessary rights to use such Input.
Output
To the extent permitted by law, you own all rights to the output generated by the Platform from your input ("Output"). However, due to the nature of the Platform, the output generated for you may not be unique to other users.
Use of Content by Softnix
Content stored on Customer's servers is not authorized by Softnix to access, use, or store such information. We do not use your inputs and outputs to train our artificial intelligence models.
In the event that you use the services of other external LLMs, you understand that the information sent will be governed by the Terms & Privacy Policy of that provider. You can contact the third-party provider directly for information on the terms of non-use of information for training:

Note: Although we and our third-party LLM providers do not use the content for practice purposes, in some cases, some of the content may still be subject to review for security reasons or government audits as required by law.
4. User Responsibility
Softnix Account Security
You are responsible for maintaining the security of your account information and password and are responsible for all activities that occur under your account.
Computer System and Network
You are responsible for:

Accuracy of Results
You understand and agree that the outputs generated by the Artificial Intelligence Platform may not always be completely accurate. You should not rely on Output as the only source of truth or as a substitute for expert advice. You are responsible for evaluating the accuracy and suitability of the output before using it.
Softnix's Responsibility
We will do everything possible to improve the quality of the Software in accordance with the goals of developing products that benefit users, technical support, bug fixes, and security patches.
5. Payment
Some platforms may have a fee. You agree to pay all services at the specified prices and conditions. You must provide accurate and complete billing information. We may suspend access to support, after-sales services, and use of the Platform if the payment fails.
6. Confidentiality and Privacy
We respect your privacy. Our Privacy Policy explains how we collect and use your personal information. We will take reasonable measures to protect your information from unauthorized access.

7. Suspension and Termination of the Platform
By User
Your use of the Software License will be subject to the conditions specified in the Software License, such as the duration or amount of Tokens.
By Softnix
We reserve the right to suspend or terminate your access to the Platform at any time if we determine that:
- You are in breach of this Agreement.
- Your use poses a risk or harm to Softnix, other users, or third parties.
- We need to comply with the requirements of the law.
8. Disclaimer and Limitation of Liability
Disclaimer
THIS PLATFORM IS PROVIDED "AS IS" (AS IS).
Softnix is not responsible for:

9. Changes to the Agreement
We may update or amend this Agreement from time to time. Changes will become effective as soon as we publish the revised Agreement. Your continued use of the Platform after the change constitutes your acceptance of the new Agreement.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Thailand, regardless of the principle of conflict of law.
