This addendum supplements the Master Terms of Service of Softnix.
1. License, Product Nature, and Acceptance of Terms
Softnix CYBOT is a Hardware Appliance licensed under a Perpetual License. It helps organizations manage IT and Cybersecurity operations, such as event analysis, summarization, operational support, and decision support under the oversight of users or administrators.
Softnix CYBOT is generally installed and operated at the customer's site or within an on-premise environment controlled by the customer. Therefore, the customer is responsible for the installation environment, network connectivity, physical access, and internal security policies for the customer's premises, unless otherwise agreed in writing.
By accessing or using Softnix CYBOT, the user accepts this product addendum, the Master Terms of Service, the Privacy Policy, and any other documents or agreements related to the product.
Softnix may update, modify, or release new versions of the software, firmware, documentation, or related terms in the future. Softnix will provide prior notice through appropriate channels, except where immediate action is required for security, legal compliance, or prevention of harm to systems and users.
2. Prohibited Use
Users must not use Softnix CYBOT in any way that is unlawful, infringes the rights of others, violates security policies, or causes harm to individuals, organizations, systems, or other services.
2.1 Privacy and Personal Data
Users must not use Softnix CYBOT to collect, process, disclose, or extract personal data of others without authorization or an appropriate legal basis, including but not limited to:
- National identification numbers
- Passport numbers
- Email addresses of others
- Phone numbers of others
- Personal data, sensitive data, or identifiable information in violation of PDPA, GDPR, or other applicable laws
2.2 Security and Cybersecurity
Users must not use Softnix CYBOT to conduct or support activities that affect system security, such as:
- Attacking, penetration testing, or disrupting systems without authorization
- Using the system to attack other systems, networks, accounts, or services
- Attempting to bypass protection systems, access controls, or security mechanisms of Softnix or third parties
- Reverse engineering, decompiling, disassembling, or attempting to extract internal service structures
- Attempting to extract model parameters, system prompts, secrets, credentials, tokens, keys, or other unauthorized internal information
- Using the product to create, distribute, or improve tools primarily intended to attack systems or evade security controls
3. Data Ownership and Output
3.1 Input
Data entered, stored, processed, or generated within Softnix CYBOT by users or customers, such as prompts, documents, files, messages, logs, metadata, configuration, security events, or analysis-related data, remains the property of the customer or the user who has rights to that data.
The user represents that they have the necessary rights, authority, consent, or legal basis to provide such data to the product.
Because Softnix CYBOT is installed and operated in the customer's environment, the customer controls storage, access, backup, export, deletion, and retention of such data according to the customer's organizational policies and applicable laws.
3.2 Output
Outputs generated by Softnix CYBOT from the user's use of the product generally belong to the user, subject to applicable laws, contractual limitations, and relevant third-party rights.
Users acknowledge that AI-generated output may not be unique. Other users may receive similar or identical outputs, and Softnix does not represent that any output is exclusive, previously unseen, or usable without further review.
Users must verify the accuracy, suitability, completeness, and legal compliance of output before using it, especially where the output may affect business decisions, security operations, legal compliance, or the rights of others.
4. Softnix Access to and Use of Data
Softnix CYBOT is installed and operated in the customer's environment. As a general rule, Softnix does not and should not directly access data inside the customer's system unless the customer authorizes or requests Softnix assistance for a specific purpose, such as installation, configuration, troubleshooting, error review, or usage support.
Softnix will not use customer data to train, develop, or improve models or services without customer authorization. Customer data in this context includes:
- Prompts
- Chat history
- Inputs
- Outputs
- Documents or data submitted into the system
- Logs, configuration, security events, or troubleshooting information
If the customer requests Softnix to investigate or resolve an issue, Softnix may use data provided by the customer or data the customer authorizes Softnix to access, only as necessary for the investigation, remediation, prevention, or improvement of system stability or security.
Softnix will not use or disclose such data for other purposes without authorization, unless required by law, an order from a competent authority, or where necessary to prevent harm or protect the security of systems or the rights of customers, users, or related persons.
5. User Responsibility for Data
Customers and users are responsible for data entered into Softnix CYBOT, for defining who may access that data, for controlling internal organizational use, and for how outputs are used. Customers and users represent that:
- They have the right or authorization to use data entered into the system
- Their use of data does not infringe copyrights, trademarks, trade secrets, or intellectual property rights of others
- Their use of data does not violate PDPA, GDPR, or other applicable personal data protection laws
- They have obtained consent or have an appropriate legal basis from the data subject where personal data or sensitive data is involved
- They will not submit unlawful, harmful, infringing, or contractually restricted data to the product
If any third-party claim, lawsuit, fine, damage, or dispute arises from data submitted by users or from the use of output, the user is responsible for the consequences to the extent provided by applicable law and relevant agreements.
Customers are also responsible for physical security of the appliance, restricting who can access the device, securing the installation area, controlling the network, backing up data, and defining internal security measures related to Softnix CYBOT usage.
6. No Warranty for Outputs
Softnix CYBOT and the software running on the appliance are provided on an "AS IS" and "AS AVAILABLE" basis, unless otherwise agreed in writing.
Softnix does not warrant that:
- Answers or outputs will be accurate, complete, current, or suitable for every purpose
- The system will be free from errors, defects, bias, or hallucinations
- The system will detect, analyze, or recommend responses to all IT or cybersecurity events correctly
- The system will be continuously available, uninterrupted, delay-free, or free from infrastructure limitations
- Outputs will be free from legal, security, privacy, or intellectual property risks
Users must exercise judgment, review, and validate outputs before using them, especially in connection with IT operations, cybersecurity, compliance, business decisions, or sensitive data.
7. Cybersecurity Responsibility
Softnix CYBOT is a support tool. It does not replace the customer's IT team, Security Operation Center, legal professionals, or security experts.
Customers and users remain responsible for security policies, system configuration, approval of impactful actions, output review, and compliance with applicable laws and organizational standards.
Softnix's role is limited to delivering the appliance, software, documentation, usage guidance, technical support, and troubleshooting related to Softnix CYBOT within the agreed scope. Softnix does not control the customer's day-to-day operations and is not responsible for the customer's physical security, network administration, user account management, or internal data management unless otherwise agreed in writing.
